End User License Agreement
BY INSTALLING AND EXECUTING DRIVERFIGHTER, YOU ACCEPT THE TERMS AND CONDITIONS SET OUT IN THIS AGREEMENT. IF YOU DO NOT AGREE TO THE LICENSE TERMS, PLEASE DO NOT INSTALL THE SOFTWARE.
License
SPAMfighter gives to the user a non-exclusive, non-transferable, non-sub-licensable, revocable and time-limited right to use DRIVERfighter.
The License gives you the right to install and execute the software, to make one copy of the software for backup purpose only and to use the software in accordance with this License Agreement.
Licensed Units
When you purchase a license you will be provided with a serial number which you can use to activate the license. You agree to use the software only for the number of licensed units specified on your invoice. Any use of more copies of the software than are licensed is prohibited.
Intellectual Property Rights
The software is copyrighted according to law. This License Agreement does not give you any intellectual property rights to the software. Any duplication of the code, abuse of the SPAMfighter or DRIVERfighter logo or rights can and will be prosecuted in accordance with Danish law.
You may not in any way amend or alter the software including but not limited to copying, reproducing, changing, modifying and decompiling the software. It is also not allowed to reverse engineer and/or disassemble code or protocols used by the software.
Restrictions on Use
You are expressly prohibited from sublicensing, selling, leasing, renting, outsourcing or in any way distributing the software that violates applicable law.
Information exchanged
DRIVERfighter does not require any e-mail for registration purposes but will create a USERID based on the configuration of your machine. This USERID is used to attach a single installation ID to a machine that can be recognized by SPAMfighter for License type/key, Subscription, statistic and support recognition purposes.
Information sent to SPAMfighter during the registration of a USERID is only machine/program related. Information such as login time and statistic regarding the amount of cleans can be sent to SPAMfighter, but for statistic and support purposes only.
During use of the program, the UserID will seek confirmation for subscription once a day.
No non-program related information is sent to SPAMfighter or used in any way
No information will be shared with 3rd party, sold or traded in any way.
SPAMfighter may use different Tracking-ID´s in the program to optimize installation procedure, navigation within the program or track the different partners of SPAMfighter. No personal information's are exchanged due to the single tracking-ID´s.
Limited Warranty
You expressly understand and agree that use of the software is provided to you under this License Agreement on an "as is" basis. The software is not subject to any guarantees.
You hereby also accept that SPAMfighter do not represent or warrant that the software will be error and defect free.
Limitation of Liability
The use of the product is at the risk of the user only and SPAMfighter cannot in any way or form be held liable for causing any direct or indirect damage, including but not limited to loss of business, loss of data, damage to any program or other software or any hardware.
The maximum liability for damages of DRIVERfighter towards the user cannot exceed an amount corresponding to the amount actually paid by the user for the use of the software.
All Drives found and shown are gathered from specification of producers to what OS and hardware installed on the PC.
If any Drivers are delivered with errors in specification, SPAMfighter can not be held liable. It is the sole responsibility of the users to install any drivers found and displayed.
Some Driver package may hold more than one Driver and it is the Users sole responsibility to find the right driver for his/her specific PC as SPAMfighter do not hold any other informations regarding that Driver Package that is displayed.
Term and Termination
This agreement commences upon payment of the license fee or upon your first installation. This agreement terminates when the license period ends or if you fail to comply with the terms of this agreement.
Governing Law and Jurisdiction
This license agreement shall be governed by the laws of Denmark.
Change of Terms
This license term may be amended at any time and the user shall keep him/her informed of any updates and if necessary update the program to the latest version.
Miscellaneous
FIGHTERtools Tray Icon
The program will attach a Tray Icon called FIGHTERtools which will show SPAMfighter´s other products and with short cuts to web pages of products not installed.
From these Product Icons you will have access to features in the products of those you have chosen to install.
DRIVERfighter does not ask for any e-mail address for downloading the product, for using it during trial or the free functionalities in the product, however, with the FIGHTERtools Tray Icon a message system is installed that will allow SPAMfighter to communicate important messages to the user regarding product updates, expiration date, offers on SPAMfighter´s own products or other important SPAMfighter related messages.
DRIVERfighter will not work without the FIGHTERtools Tray Icon installed.
If you purchase the program, SPAMfighter can choose to forward email messages regarding the product, the company SPAMfighter or update / expiration notifications.
If you have selected the optional information about trusted partners, you will receive mails regarding these, but only from SPAMfighter and never from the partner. You can always opt-put from receiving trusted partner information.
The user is obliged to indemnify SPAMfighter for any claim for damages directed at SPAMfighter owing to actions on the part of the user and the use of DRIVERfighter.
